Customer Terms & Conditions

1. Quotations and Acceptance

1.1. All quotes issued by Arcworks Aluminium & Steel are valid for 30 days from the date of issue unless otherwise stated.

1.2. Acceptance of a quote constitutes acceptance of these Terms and Conditions in full, unless the customer notifies Arcworks in writing of any objections prior to making a deposit or formally confirming the job.

2. Payment Terms

2.1. Tiered Upfront Deposits

Upon acceptance of a quote, the following deposit structure applies:
– Projects under $10,000: 50% deposit
– Projects between $10,000 and $30,000: 40% deposit
– Projects over $30,000: 30% deposit

No work will commence until the required deposit is received in full unless alternative milestone payment arrangements have been written and approved between parties prior to commencement.

2.2. Progress and Final Payments

2.2.1. For larger or staged projects, Arcworks may issue progress invoices based on key project milestones.

2.2.2. A final invoice will be issued upon completion of installation or delivery and is payable within 7 business days of the invoice date.

3. Payment Methods

3.1. Payments must be made via electronic funds transfer or other approved payment methods stated on the invoice.

3.2. All amounts are exclusive of GST unless specifically stated otherwise.

4. Delays and Cancellations

4.1. If a project is delayed by the customer beyond 14 calendar days after the deposit has been paid, Arcworks reserves the right to:
– Adjust the pricing to reflect updated costs
– Retain the deposit to cover materials ordered or time committed

4.2. Cancellations must be submitted in writing. Deposits are non-refundable once materials have been ordered or fabrication work has commenced.

5. Ownership and Risk

5.1. Ownership of all materials and products remains with Arcworks until full payment is received.
5.2. Risk in the goods passes to the customer upon delivery or completion of installation.

6. Warranties and Liability

6.1. Arcworks warrants all workmanship for a period of 12 months from the date of installation.

6.2. This warranty excludes defects caused by misuse, external damage, environmental exposure, or wear and tear.

6.3. To the maximum extent permitted by law, Arcworks will not be liable for indirect, incidental, or consequential losses.

7. Dispute Resolution

7.1. In the event of a dispute, both parties agree to attempt resolution in good faith before pursuing legal action.

7.2. These terms are governed by the laws of the state in which the services are provided.

8. Acknowledgement and Acceptance

By signing, the client acknowledges and accepts the Terms and Conditions outlined above.
